В МВД рассказали, как легально трудоустроиться в Польше и не попасть на недобросовестных нанимателей

    01.05.2018
Belarusians have started to go abroad for work more frequently. According to official statistics, our compatriots are most actively going to work in Russia and Poland. The Ministry of Internal Affairs reports that Belarusians who want to go to work in Poland have recently started to ask questions more often, the department notes. The head of the Department of Citizenship and Migration of the Ministry of Internal Affairs of Belarus, police colonel Aleksei Begun, spoke about the peculiarities of employment in the neighboring country.

The increase in the number of Belarusians going to work in Poland is primarily due to the simplified procedure for employment, which applies to citizens of Belarus, Armenia, Georgia, Moldova, Russia, and Ukraine, the Ministry of Internal Affairs explains.

       — The so-called application procedure allows you to work for 6 months in a 12-month period without obtaining permission. And from January 1 of this year, foreign citizens can work in Poland on the basis of a seasonal work permit for 9 months during the year, — says Aleksei Begun.

The specialist reminds that it is possible to find a job abroad with the assistance of legal entities or individual entrepreneurs who have a license from the Ministry of Internal Affairs for such activities.

       — Today, 200 legal entities and individual entrepreneurs are engaged in this activity: 91 licensees employ citizens of Belarus with employers in Russia, and 77 — in Poland. However, it should be remembered that even when turning to licensees for help in finding work abroad, it is necessary to read the employment assistance agreement and the employment contract carefully before signing.

Companies that provide assistance in finding a job abroad provide accurate information about the future employer and the conditions for carrying out labor activities, the representative of the Ministry of Internal Affairs adds.

       — Thus, the conclusion of employment contracts with foreigners and foreign organizations that are not direct employers is prohibited. The exception is employment outside our country under student programs. Licensees are also required to ensure that foreign employers conclude employment contracts with immigrant workers or conclude employment contracts on behalf of the foreign employer. At the same time, they are obliged to issue to immigrant workers, before their departure, one copy of the employment contract registered with the departments of citizenship and migration.

When employed in Poland, Belarusians, according to Aleksei Begun, most often complain about untimely payment of wages and unreliable information about living conditions and meals.

       — Each such case requires a detailed investigation. We conduct a check on the possibility of holding the guilty parties accountable. But at the same time, we must understand that violations are easier to prevent than to restore the legality of violated rights and interests, — explains Alexey Begun.

At the same time, Belarusians can look for suitable employment options on their own, the specialist recalls.

       — Some Belarusians go to work on their own. They look for job offers through acquaintances, friends, relatives, and the internet. Most often, in such cases, information about the предполагаемой work is very scarce and does not fully correspond to reality. Those who choose this path may not have legal status in the host country and, if their rights are violated, may find themselves absolutely defenceless, — says Alexey Begun.

The specialist cited a recent example from practice.

       — The competent authorities of Poland have completed an investigation into a criminal case against two citizens of Poland and Ukraine, who, between July 2015 and October 2016, recruited people in some regions of Belarus and Ukraine. The defendants ensured their arrival in Poland якобы for employment in well-paid jobs. Foreigners who did not know the procedure for employment and stay in Poland were sent to gastronomic establishments in Warsaw, where they worked more than 350 hours a month. Employees did not receive remuneration on time, they were psychologically oppressed, insulted and humiliated, and fined without good reason.

The Ministry of Internal Affairs says that today, among foreign employers, the most popular practice is to place advertisements for recruiting workers and then organize their departure, without concluding any contracts.

       — It is also common to conclude an additional (or new) contract in a foreign country, worsening the working and living conditions. And finally, sending the employee to a «third party» — to another facility. But, as mentioned above, in this case, no one can give guarantees that you will not be deceived.

Alexey Begun reminds that the Department of Citizenship and Migration of the Ministry of Internal Affairs of Belarus has a hotline for safe employment abroad — 218 52 64. More than a thousand calls are received on this number every year.

Thus, in the first quarter of this year, 2187 people left to look for work abroad, while in the same period last year, there were 348 fewer people.

The most active in January-March this year, Minsk residents went to work for money — 697 people (compared to 426 a year earlier). On the other hand, residents of the Minsk region almost stopped going to other countries in search of income — only 12 people in the first quarter (compared to 62 a year ago).

In Russia, 1030 Belarusians found work in January-March, in Poland — 686 people, in Lithuania — 308, in the USA — 46, in the Czech Republic — 45, in China — 19, and in Qatar — 13.

The majority of Belarusians — 1284 people in January-March — went to work under labor contracts for up to six months, mainly to Poland (670) and Russia (568). On the other hand, people usually go to Lithuania under contracts for more than a year (266 people in the first quarter).

Belarusian workers are in demand mainly in Russia (1003), Poland (672), Lithuania (308), and the Czech Republic (45). In the USA and Turkey, our compatriots most often find jobs in trade and service organizations — 41 and 19 people, respectively. However, only one Belarusian was hired for a managerial position abroad in January-March — in Poland.

Our compatriots legally found employment in the first quarter in 18 countries, including Turkey, Japan, Hong Kong, Italy, Korea, and Finland.
