Marrying a foreign national in the Republic of Belarus

Marriage between Belarusian citizens and foreigners is becoming a common occurrence. Every year there is an increase in the number of such marriages. According to official statistics, this figure has been steadily increasing in recent years, indicating the active integration of Belarusian society into the global community.
The process of registering a marriage with a foreigner has a number of features and is regulated by the Code of the Republic of Belarus on Marriage and Family. The marriage is registered by the registry office at the place of residence of one of the spouses. It is necessary to take into account the legal nuances related to citizenship and the place of permanent residence of the spouses.
Foreigners planning to conclude a marriage in Belarus must obtain a short-term visa (type "C" – tourist or private). The visa is issued at the diplomatic mission of Belarus abroad. In some cases, it is possible to use the visa-free regime if the foreign citizen belongs to a category that has the right to visa-free entry.
When submitting an application for marriage, a foreign citizen must be registered with the internal affairs bodies at the place of temporary stay in Belarus. Such registration confirms the legality of his stay in the country and is a mandatory condition for submitting documents to the registry office.
According to paragraph 5.2 of the list of administrative procedures (Decree of the President of the Republic of Belarus No. 200 of April 26, 2010), the following are required to conclude a marriage:
• an application of the established form;
• documents identifying the identity of the spouses;
• documents confirming the termination of previous marriages (if any);
• a document confirming payment of the state fee;
• a certificate of absence of obstacles to marriage issued by the competent authority of the foreign citizen's country.
Documents issued by competent authorities of foreign countries must be legalized or apostilled in the prescribed manner. A notarized translation of the documents into Russian or Belarusian is also required.

Marriage registration is carried out after a month from the date of submission of the application. If there are valid reasons, marriage registration is possible before this period.
Foreign citizens and stateless persons who do not have a permanent residence permit can conclude a marriage in Belarus on a general basis by presenting documents confirming the legality of their stay.
After registering the marriage, a foreigner can apply for a temporary or permanent residence permit in Belarus based on the concluded marriage. This allows them to legally stay, reside, and find employment in the country.
